BUT IT'S ALSO A VERY DIFFICULT DAY FOR SO MANY PEOPLE IN THIS COUNTRY AND AROUND THE WORLD.

AND OUR HEARTS ARE VERY, VERY HEAVY FROM THE ATROCITIES IN THE MIDDLE EAST, IN PARTICULAR IN GAZA AND THE LOSS OF LIFE AND THE TAKING OF HOSTAGES.

AND MOST OF US UNDERSTAND THAT THIS INCLUDES AMERICANS.

SO THERE ARE AMERICANS THAT HAVE LOST THEIR LIVES AND AMERICANS THAT ARE CURRENTLY BEING HELD HOSTAGE.

AND SO TODAY I WANT TO INVOKE AND ASK GOD FOR HIS HIS GUIDANCE FOR THOSE OF US IN POSITIONS OF AUTHORITY AROUND THE WORLD, BUT IN PARTICULAR IN THE MIDDLE EAST AND IN THE US, THAT WE ARE MEASURED IN OUR RESPONSE, BUT THAT WE ARE STRONG AND STEADFAST IN OUR RESPONSE, BUT THAT WE REMEMBER RIGHT NOW.

THE MOST IMPORTANT PEOPLE ARE THOSE FAMILIES THAT HAVE BEEN IMPACTED AND LOST LOVED ONES.

AND SO, WE PRAY, LORD, THAT YOU BRING THE HOSTAGES HOME SAFELY AND THAT THIS CONFLICT ENDS SOON VERSUS LATER.

I LOVE HISTORY.

IT WAS 8TH OCTOBER 1871, THE GREAT FIRE OF CHICAGO.

IT WAS A HORRIBLE DISASTER.

MORE THAN 300 PEOPLE WERE KILLED.

17,000 BUILDINGS WERE DESTROYED.

NOT TOO MUCH.

LATER, A COUPLE OF YEARS AFTER THAT WAS THE JOHNSTOWN FLOOD.

1878. AND OF COURSE, AFTER THAT, SOON AFTER, THAT WAS THE GALVESTON FLOOD.

THESE HISTORICAL DISASTERS OR IN OUR IN OUR HISTORY.

AND WE NEED TO LOOK BACK AT ONCE IN A WHILE TO UNDERSTAND THAT HISTORY AS WE GO FORWARD.

BECAUSE THE LOSSES OF THOSE THREE DISASTERS THAT OCCURRED WITHIN THREE DECADES, THERE WAS A LOT OF HUBRIS ABOUT WE DON'T NEED THAT.

PEOPLE IN GALVESTON WANTED A SEAWALL, BUT THE CITY PEOPLE ARE RUNNING.

THE CITY SAID, NO, WE DON'T NEED THAT.

WE'LL NEVER HAVE A HURRICANE HERE.

WELL, GALVESTON WAS BUILT ON A SAND DUNE, ESSENTIALLY.

AND OF COURSE, WE KNOW WHAT HAPPENED TO THAT SAND DUNE.

PEOPLE WERE TOLD ABOUT THE HURRICANE COMING AND THEY SHUT THE NEWS OFF.

PEOPLE IN CUBA WERE WARNING ABOUT THE HURRICANE COMING.

THEY SHUT THE CUBAN METEOROLOGISTS OFF FROM TALKING TO US.

IT WAS HUBRIS OF THE ELECTED OFFICIALS AND GOVERNMENT APPOINTEES THAT SAID WE DON'T HAVE A PROBLEM HERE.

THEY KNEW THEY HAD A PROBLEM AND THEY IGNORED IT.

THE JOHNSON JOHNSTOWN FLOOD, THERE WAS A DAM THAT WAS BUILT HIGH UP IN THE MOUNTAINS.

AND IT WAS USED INITIALLY FOR PROVIDING WATER FOR A CANAL BECAUSE AT THE TIME CANALS WERE IMPORTANT, BUT THEY DID NOT NEED THE CANAL ANYMORE BECAUSE THE ADVENT OF RAILROADS NEGATED THE NEED FOR THE CANALS.

SO, SOME WEALTHY ELITE PEOPLE FROM PITTSBURGH MADE IT A FISHING CAMP.

WELL, THEY SAY IT WAS AN ACT OF GOD THAT CAUSED THE FLOOD.

WELL, THEY CHANGED THE HEIGHT OF THE DAM.

THEY CHANGED THE WAY THE OUTFLOW WAS CARRIED ON.

SO. WEALTHY PEOPLE HIGH ABOVE EVERYBODY ELSE CHANGED ENGINEERING PRINCIPLES.

FOR THEM FOR THEIR OWN BENEFIT.

AND JUST LOTS OF LIVES WERE LOST IN THE CHICAGO FIRE.

HOMES WERE BUILT.

THE GERMAN AND ITALIAN AND POLISH IMMIGRANTS WERE PUT IN ONE SECTION OF TOWN, GIVEN VERY LITTLE SPACE TO LIVE.

ALL THE NORTHERN PINES WERE CUT DOWN FROM MICHIGAN AND WISCONSIN.

HOMES WERE BUILT CLOSE TOGETHER, WITH ASPHALT AND TAR ROOFS.

ONE LITTLE FIRE, AND THEY BLAMED IT ON A COW.

IT WAS NOT MRS. O'LEARY, AND SHE WASN'T MRS. O'LEARY AS KATHERINE LEARY.

YES, SHE WAS IRISH.

BUT THE HUBRIS OF THE DAY WAS, OH, THESE IRISH IMMIGRANTS CAUSED THIS FIRE.

THEY BLAMED IT ON A COW, TOO.

IT'S JUST REALLY SAD.

SO, THESE ACTS OF GOD, THE HUBRIS, THIS FAULTY ENGINEERING, WE HAVE RESPONSIBILITY.

CHANGE OF CLIMATE IS NOT AN ACT OF GOD.

WE ARE DOING THAT AND WE'RE DOING IT TO OURSELVES.

SO. WHENEVER WE MAKE A PLAN.

WHENEVER WE CONTRACT, LET A CONTRACT WHENEVER WE.

DEVELOP A CODE WITHOUT THE CODE.

FOR THE RECORD, I AM A PROFESSIONAL CIVIL ENGINEER AND I'VE WORKED FOR 40 YEARS IN WATER RESOURCE AND ENVIRONMENTAL ENGINEERING.

I'M HERE THIS EVENING TO SPEAK TO THE AGENDA ITEM 3.B, THE DOOR DART DRIVE PROPERTY PURCHASE.

AND IF I HAVE TIME, THE TREE ANALYSIS THAT WAS PRESENTED IN STEVE SWAN'S STAFF REPORT.

LET ME START BY SAYING THAT THE PHASE ONE IS A DONE BY THE BLACKLEDGE GROUP WAS IN FACT.

A THOROUGH, WELL WRITTEN.

AND IT ALSO FOLLOWED THE MOST RECENT ASTM STANDARD.

SO, GENERALLY THEY DID A GOOD JOB.

UM. I AGREE WITH THE TWO RECOGNIZED ENVIRONMENTAL CONDITIONS THAT THEY IDENTIFIED THE RAISED MOUNDS ON THE SITE WITH THE TRASH AND THE PRINTING BUSINESS ENCROACHMENT.

I DO, HOWEVER, HAVE ONE QUESTION THAT I WAS NOT ABLE TO ANSWER WITH.

MY REVIEW OF THEIR REPORT, AND MAYBE THE COMMISSION WOULD LIKE TO ASK STEVE SWANN OR THE TBG GROUP TO ANSWER THIS QUESTION.

A DISCARDED TRANSFORMER WITH THE LID OFF WAS OBSERVED ON THE SITE AND A PHOTOGRAPH.

IT WAS PHOTOGRAPHED AND A PHOTOGRAPH WAS INCLUDED IN APPENDIX A OF THEIR REPORT.

PRIOR TO 1979, ELECTRICAL TRANSFORMERS CONTAINED PCBS AND WHICH IS A PERSISTENT CHEMICAL IN THE ENVIRONMENT.

AND EVEN THE NEWER VERSIONS HAD MINERAL OIL IN THEM, WHICH COULD CAUSE SOIL OR GROUNDWATER CONTAMINATION.

MY QUESTION IS THIS WHY DOES THE REPORT IN SECTION 6.3.4 STATE THAT NO TRANSFORMER WAS OBSERVED WHEN IN FACT THEY PHOTOGRAPHED ONE AND THE SECOND WAS, WHY WAS THE TRANSFORMER NOT LISTED AS A RECOGNIZED ENVIRONMENTAL, A THIRD RECOGNIZED ENVIRONMENTAL CONDITION? I AGREE WITH TDG'S CONCLUSIONS THAT THE SUBJECT SITE COULD NOT BE FULLY EVALUATED.

THEREFORE, FURTHER ASSESSMENT IS RECOMMENDED.

STEVE SWANN HAD A SIMILAR STATEMENT IN HIS STAFF REPORT.

I AGREE WITH THE RECOMMENDATION IN STEVE'S REPORT.

THE CITY OF ATLANTIC BEACH SHOULD ASK FOR ADDITIONAL TIME TO COMPLETE A PHASE TWO ESSER.

IN MY OPINION, REFUSAL BY THE OWNER TO ALLOW ADDITIONAL TIME SHOULD BE VIEWED AS A RED FLAG, SUGGESTING CONCERN OVER WHAT YOU MAY FIND.

THIS COULD BE A VERY EXPENSIVE LIABILITY FOR THE CITY OF ATLANTIC BEACH.

IF YOU DON'T DO THE PHASE TWO STUDIES, THE CITY COULD BE ADVERSELY AFFECTED BY THE LIABILITY PROVISIONS OF THE FEDERAL REGULATIONS, SPECIFICALLY SUPERFUND AND CERCLA.

THE INNOCENT LANDOWNERS.

LIABILITY DEFENSE REQUIRES ALL APPROPRIATE INQUIRY.

THE CITY OF ATLANTIC BEACH NOW HAS BEEN PRESENTED WITH A PHASE ONE REPORT THAT SAYS ADDITIONAL ASSESSMENT IS REQUIRED.

STEVE HAS A SIMILAR STATEMENT IN HIS STAFF REPORT.

ALL ADDITIONAL INQUIRY ALSO REQUIRES.

AN ASSESSMENT OF THE RELATIONSHIP BETWEEN THE PURCHASE PRICE OF THE AND THE FAIR MARKET VALUE OF THE PROPERTY IF THE PROPERTY IS NOT CONTAMINATED AND, IN THIS CASE, THE PURCHASE PRICE IS LESS THAN 50% OF THE MARKET VALUE.

APPRAISALS, THAT SHOULD BE ANOTHER RED FLAG.

NOW, WITH RESPECT TO THE TREE ANALYSIS, THE ANALYSIS PRESENTED BY STEVE AND HIS REPORT, IN MY OPINION, DOES NOT ADDRESS THE APPROPRIATE QUESTION.

I THINK THE APPROPRIATE QUESTION IS THIS HOW MANY TREES REGULATED UNDER THE CITY'S CODE WOULD HAVE TO BE REMOVED TO ACHIEVE THE STORMWATER MANAGEMENT OBJECTIVES FOR THIS PROPERTY? IF WE CAN'T ANSWER THAT QUESTION CLEARLY AND UNDERSTAND WHAT THE IMPACTS MAY BE, THEN I DON'T SEE HOW THIS COMMISSION CAN A COUNCIL SORRY, CAN MAKE AN INFORMED DECISION ON THE PURCHASE OF THAT PROPERTY.

I AGREE WITH OUR CITY ENGINEER, WITH HIS REPORT AND WITH HIS ASKING FOR AN ADDITIONAL 45 DAYS SO THAT WE WOULD BE ABLE TO DO THE PHASE TWO EVALUATION SO WE'D REALLY KNOW WHAT IS ON THE PROPERTY.

I FEEL THAT WHENEVER YOU ARE BUYING PROPERTY I WAS IN REAL ESTATE AND I WOULD NEVER EVER RECOMMEND THAT A BUYER BUY A PIECE OF PROPERTY WITHOUT GETTING A THOROUGH INSPECTION.

AND I THINK THIS IS WHAT WE ARE DOING.

IF WE DO THE PHASE TWO THAT WE NEED TO DO THAT, PARTICULARLY SINCE PHASE ONE HAS POINTED OUT THAT THERE ARE TWO MOUNDS THAT ARE QUESTIONABLE AND THEY SUGGEST THAT WE THAT WE DO FURTHER EVALUATION.

AND ALONG WITH GETTING THE 45 DAYS WHEN WE'RE NEGOTIATING WITH SOMEBODY IN GOOD FAITH, YOU WOULD HOPE THAT THEY WOULD.

DEFINITELY GIVE YOU THE 45 DAYS.

WHY NOT? WHAT? WHAT WOULD THE OWNER HAVE TO LOSE? UNLESS THE OWNER HAS A REASON NOT TO WANT FURTHER INVESTIGATION OF HIS PROPERTY? SO, I WOULD URGE YOU TO FOLLOW WHAT THE STAFF IS SUGGESTING AND THEN ALSO HAVE IN THAT AND ASKING FOR THE EXTRA 45 DAYS THAT ALONG WITH THAT, THAT MEAN THAT SHOULD HE, SHOULD HE NOT ACCEPT THAT TO MAKE IT CLEAR THAT YOU AS A COMMISSION WOULD WALK AWAY FROM IT BECAUSE.

WHAT WOULD HAPPEN IF WE DID.

THE PHASE TWO FOUND THAT THERE WAS TOXIC MATERIAL THERE AND THEN WE NEEDED ANOTHER MILLION DOLLARS TO CLEAN THAT UP TO BE ABLE TO USE IT FOR WHAT IT IS SUPPOSED TO BE USED FOR A RETENTION POND.

AND CERTAINLY, THE CITIZENS OF AQUATIC GARDENS DESERVE THAT AND DESERVE TO KNOW THAT THE PROBLEM WOULD BE SOLVED. SO, THANK YOU SO MUCH FOR YOUR TIME.

WHEN WE COMMISSIONED THIS PHASE ONE STUDY, HOPEFULLY EVERYONE APPRECIATED YOU CALL IT PHASE ONE BECAUSE THERE IS A PHASE TWO.

AND IT'S KIND OF ASTONISHING TO ME THAT WE'RE WE WOULD EVEN CONSIDER NOT DOING THE PHASE TWO PORTION OF THE STUDY.

IN ADDITION, WE DID REQUEST, AS YOU KNOW, 90 DAYS ORIGINALLY FROM THIS SELLER AND HE REFUSED.

SO, I THINK WE NEED TO GO INTO THIS THINKING HE MAY REJECT OUR REQUEST FOR ADDITIONAL 45 DAYS.

AND THEN WHAT? SO, I HOPE THIS COMMISSION DECIDES TONIGHT WHAT THEY'RE GOING TO DO WHEN THE 45-DAY EXTENSION IS REFUSED, BECAUSE IT WILL BE. WHY WILL IT BE? I'M NOT SURE. YOU CAN SPECULATE THAT MAYBE HE DOESN'T WANT THE PHASE TWO STUDY KNOWN BECAUSE IT COULD NEGATIVELY IMPACT A FUTURE SALE OF THIS PROPERTY.

BUT THE IMPORTANT THING FROM MY STANDPOINT AND HOPEFULLY FROM YOURS, IS THAT YOU ARE STEWARDS OF OUR MONEY.

AND THIS IS A $1.075 MILLION PURCHASE WHERE WE HAVE LITERALLY NOT EVEN SCRATCHED THE SURFACE TO FIND OUT WHAT'S GOING ON WITH THIS PROPERTY.

I MIGHT REMIND YOU ALSO THERE WAS A VERY SIMILAR INCIDENT ON LILY LANE RECENTLY WHERE THE PHASE TWO EXAMINATION DID IN FACT SHOW CONTAMINANTS AND THE CITY WISELY PULLED OUT OF THAT DEAL. A LITTLE HISTORY ON THE PARCEL SHOWS THAT ACCORDING TO REDFIN, THIS PARTICULAR PROPERTY IS VALUED AT $622,000. IT WAS SOLD ORIGINALLY BACK IN 2016 FOR $225,000 AND THEN AGAIN IN 2017 FOR $350,000.

SO IT WAS LISTED A LITTLE OVER A YEAR AGO FOR 1.075.

AND APPARENTLY THE CITY OFFERED FULL ASKING PRICE.

SO ONE OF THE RATIONALES I'VE HEARD ABOUT WHY WE SHOULD BUY THIS PROPERTY IS WE CAN HOLD IT AND PREVENT ANYONE ELSE FROM DEVELOPING IT.

BUT THAT SOUNDS NOBLE.

BUT REALLY, WE'RE NOT IN THE BUSINESS OF BUYING REAL ESTATE AND IT WOULD NOT BE A RESPONSIBLE MOVE.

SOMEONE WHO'S FAMILIAR WITH OUR SITUATION TOLD ME, AND I QUOTE, IF ATLANTIC BEACH PROCEEDS WITH EXCAVATION WITHOUT FULLY KNOWING WHAT IT'S DEALING WITH, THEY ARE RISKING REINTRODUCING CONTAMINANTS INTO THE ECOSYSTEM, ESPECIALLY THE NEARBY CREEK.

I WILL TAKE THE BLAME FOR THAT BECAUSE I ASKED TO HAVE TIME TO ACTUALLY READ THE SUBSTANTIAL NUMBER OF CHANGES AND UNDERSTAND THEM BEFORE WE PROCEEDED.

SAME THING THAT'S IN THE IN THE DRAFT STAFF REPORT AND WE'LL JUST RUN THROUGH KIND OF WHERE WE'RE AT FROM A DUE DILIGENCE, DUE DILIGENCE PERSPECTIVE ON THIS PROPERTY.

UM, JUST TO REMIND YOU WHERE IT IS BETWEEN MAYPORT ROAD AND FRANCIS, JUST SOUTH OF SOUTH OF SIMMONS AND HOW IT TIES IN WITH OTHER PROPERTIES THAT THE CITY OWNS ALONG THIS DRAINAGE WAY.

UM, AND REMIND YOU THAT THE DRAINAGE WAY GOING THROUGH THIS PROPERTY, WE HAVE NO EASEMENT ON THIS PROPERTY, ON THAT DITCH RIGHT NOW.

NEVER HAD ONE. WE HAD TWO PROPERTY APPRAISALS AS REQUIRED BY FLORIDA STATUTES.

WE NEED TWO APPRAISALS.

WE GOT ONE INITIALLY, AND THEN WHEN WE ENTERED THE DUE DILIGENCE PERIOD, WE WENT AHEAD AND GOT THE SECOND ONE AND THEY'RE FAIRLY SIMILAR AND THAT ASSUMES FULLY BUILT OUT WITH WHAT'S PROVED IN TERMS OF ZONING AND AND OTHER LAWS.

BRIAN RIDDELL FROM THE PLANNING DEPARTMENT DID A TREE SURVEY OUT THERE.

AND THE KIND OF THING THEY NOTICE IS THAT A LOT OF THE BIG TREES OUT THERE ARE CAMPHOR TREES WHICH ARE WHICH ARE INVASIVE SPECIES ARE NOT A PROTECTED TREE.

THEY LOOK NICE, BUT THEY TAKE OVER EVERYTHING.

SO, WHICH IS WHY THEY'RE, WHY THEY'RE INVASIVE.

THERE ARE SOME DECENT TREES ON THE NORTHWEST PART OF THE PROPERTY, SOME SYCAMORES AND THE MIXTURE OF OAK AND SOME PALMS ON THE EASTERN SIDE.

AND WE PROBABLY WHATEVER WORK WE DID OUT THERE IN TERMS OF THE STORMWATER POND, WE'D STAY AWAY FROM MOST OF THOSE TREES.

SOME OF THEM WILL PROBABLY HAVE TO COME DOWN, BUT WE TRY TO PROTECT THE FRINGES AND STAY AWAY FROM MOST OF THEM.

IF THE PROPERTY WAS DEVELOPED TO BE DEVELOPED TO MEET THAT, APPRAISAL ESTIMATE, EVERY ONE OF THESE TREES PRETTY MUCH WOULD BE GONE.

SO, I MEAN, WE CAN'T CONTROL THE TREES ON THE PROPERTY RIGHT NOW, BUT WE CAN IF WE OWN THE PROPERTY, WE CAN PICK AND CHOOSE WHICH ONES THAT WE CHOOSE TO SAVE.

THAT'S KIND OF LOOKING AT AN AT AN AREA.

YOU CAN SEE THE CAMPFIRES REALLY TAKE UP THE BULK OF THE PROPERTY.

AND THE OPEN AREA AND THE AREA OF THE CAMPFIRES IS THE MOST LIKELY AREA WE'D WANT TO DO SOME TYPE OF STORMWATER POND IN THE FUTURE TO HELP US OUT WITH THE AQUATIC GARDENS ISSUE. MOVING ON TO THE PHASE ONE ENVIRONMENTAL ASSESSMENT, YOU DO A PHASE ONE, YOU CALL IT A PHASE ONE, NOT BECAUSE YOU AUTOMATICALLY GO TO A PHASE TWO, YOU CALL IT A PHASE ONE, AND IT FOLLOWS VERY STRICT GUIDELINES.

AND AT THE PHASE ONE COMES BACK AND SAYS, WE'VE FOUND NO RECOGNIZED ENVIRONMENTAL CONDITIONS.

IT GIVES YOU LIABILITY PROTECTION, AS GREG SAID, FROM HAZARDOUS WASTE LAWS AND CIRCLE LAWS.

BUT IN THIS CASE, WE DIDN'T FIND MUCH IN THE PROPERTY, OR OUR CONSULTANT DID NOT FIND MUCH IN THE PROPERTY EXCEPT FOR SEVERAL SOIL MOUNDS AND AN ENCROACHMENT ON THE NORTHWEST CORNER OF THE PROPERTY WHERE THERE'S SOME PRINT SHOP ACTIVITY GOING ON.

SO, AND HE DID NOT BRING UP THE HE DID HAVE A PICTURE OF THE OF THE TRANSFORMER BUT DID NOT MENTION IT ELSEWHERE IN THE REPORT AND DON'T HAVE CLARIFICATION FROM HIM ON THAT BUT I'LL GET THAT BUT I ASSUME IT WAS JUST A SHELL OF A TRANSFORMER LINE ON TOP OF LEAVES THAT NO EVIDENCE OF ANY KIND OF LEAKAGE OR, YOU KNOW, THE TRANSFORMER WAS PROBABLY EMPTY AND CONTENTS REMOVED BEFORE IT WAS DUMPED THERE OR HOWEVER LONG AGO.

AND IT MAY HAVE BEEN FAIRLY RECENT.

I DON'T KNOW, BUT I CAN GET CLARIFICATION ON THAT.

SO, WE HAVE THE TWO RECOGNIZED ENVIRONMENTAL CONDITIONS, WHICH IF YOU'RE GOING TO MOVE FORWARD, AUTOMATICALLY TRIGGERS THAT YOU WOULD GO INTO A PHASE TWO.

THE PHASE ONE IS STRICTLY RECORD SEARCH AND A SITE REVIEW AND INTERVIEWS WITH PROPERTY OWNERS AND FORMER PROPERTY OWNERS AS THEY CAN BE FOUND.

AND THE PHASE TWO IS ACTUALLY WHERE YOU YOU GO IN WHERE YOU HAVE THESE RECOGNIZED ENVIRONMENTAL CONDITIONS AND YOU EXPLORE THEM IN ENOUGH DETAIL TO MEET THE REQUIREMENTS TO ASSURE THAT THERE'S NO CONTAMINATION.

HOPEFULLY CONFIRM THERE'S NO CONTAMINATION THERE.

AND IF IT'S DONE RIGHT, THEN WE WOULD NOT HAVE ANY LIABILITY IF THEY DON'T FIND ANY CONTAMINATION.

SO WITH THE SOIL MOUNDS, WE'D PROBABLY OPEN THOSE UP WITH A BACKHOE.

JUST THEY'RE NOT HUGE, BUT IT LOOKS LIKE MOSTLY CONSTRUCTION DEBRIS.

BUT YOU DON'T KNOW UNTIL YOU POP THEM OPEN AND SEE WHAT'S IN THERE.

THEY'VE BEEN THERE FOR A LONG TIME.

AND ASSUMING THAT STITCHES AND SCREENS OPERATES WELL, THERE'S PROBABLY NOT A PROBLEM THERE EITHER.

BUT WE'RE GOING TO DO SOME GROUNDWATER SAMPLES AND SOME SOIL SAMPLES THERE TO TO CONFIRM THAT.

SO YEAH, WE CAN'T CLOSE ON THE PROPERTY IN OUR DUE DILIGENCE PERIOD BECAUSE OF PHASE ONE IS NOT CLEAN.

IF THE PHASE ONE HAD COME BACK CLEAN, THAT WOULD HAVE BEEN A DIFFERENT STORY.

SO, WE DO NEED WE NEED TO REQUEST AN EXTENSION.

45 DAYS IS ADEQUATE MORE THAN ADEQUATE TO DO THAT.

AND I WOULD RECOMMEND THAT WE PROCEED WITH CONDUCTING A PHASE TWO ENVIRONMENTAL ASSESSMENT ON THE PROPERTY IF YOU WISH TO MOVE FORWARD.

AND THAT'D BE PROBABLY ABOUT $10,000 OR LESS TO HAVE THAT WORK DONE IN THAT IN THAT CASE, WE'D LOOK AT THOSE TWO ISSUES THAT WERE FOUND OUT THERE AND MAKE A DETERMINATION OF WHETHER IT'S CLEAN OR IT'S NOT CLEAN.

AND THAT'S ALL I'VE GOT. IF YOU HAVE ANY QUESTIONS.

CAN YOU GIVE US YOUR OPINION? BECAUSE WE HEARD A LOT OF COMMENT TONIGHT ABOUT THE FEASIBILITY OF THIS PLAN IN THE FIRST PLACE.

AND I'VE TALKED TO YOU ABOUT IT, AND I FEEL LIKE THE STORMWATER PROBLEM IS GOING TO BE GREATLY REMEDIED BY THIS.

I MEAN, CAN YOU JUST COMMENT ON THAT? WELL, ONE OF THE THINGS THAT I THAT I DID TELL YOU ALL I WAS GOING TO DO BEFORE WE GOT TO THE POINT WHERE WE WERE GOING TO CLOSE ON THIS PROPERTY WAS DO A BENEFIT COST ANALYSIS IN TERMS OF HOW MUCH IMPROVEMENT WE COULD GET ON THIS PROPERTY FOR A STORMWATER PROTECTION AS OPPOSED TO WHAT WE HAVE, THE COST OF WHAT WE HAVE PLANNED DOWNSTREAM AND WHAT'S FEASIBLE DOWNSTREAM IN THE AQUATIC GARDENS NEIGHBORHOOD AREA.

AND THAT TAKES QUITE A BIT OF TIME TO DO THAT.

AND MY LIMITED TIME OPTED NOT TO PROCEED ON THAT UNLESS YOU WANTED TO REQUEST AN ADDITIONAL 45 DAY EXTENSION.

BUT I WOULD EXPECT THAT THE NEXT COMMISSION MEETING IN TWO WEEKS IF YOU ALL OPT TO REQUEST AN EXTENSION AND MOVE FORWARD, THE NEXT COMMISSION MEETING COULD WORK UP THAT BENEFIT COST ANALYSIS AND PUT IT IN FRONT OF YOU.

THE WHOLE ISSUE WITH THE AQUATIC GARDENS DRAINAGE SYSTEM IS THE BIGGEST PROBLEM IS WE CAN'T GET WATER OUT OF THERE, WHICH IS WE HAVE THAT PROJECT OUT TO BID RIGHT NOW.

AS A MATTER OF FACT, WE HAVE A PRE-BID MEETING TOMORROW AND HOPEFULLY WE GET A GOOD NUMBER OF CONTRACTORS HERE TO TALK TO ABOUT THE PROJECT.

BUT THE OTHER ISSUE IS WE DON'T HAVE MUCH STORAGE, SO WHEN IT RAINS, THE WATER HAS NOWHERE TO GO.

SO ONE OF THE RECOMMENDATIONS IN OUR 2018 STORMWATER MASTER PLAN UPDATE WAS TO TRY TO EXPAND THE AQUATIC GARDENS POND BY BOTH PURCHASING THE BEACHES AQUATIC CLUB AND ALL THE HOMES IN THE NORTH SIDE OF THE POND.

WELL, THAT'S NOT FEASIBLE IN THIS DAY AND AGE FOR THAT TO HAPPEN.

SO WE HAVE TO LOOK FOR WHERE ELSE CAN WE GRAB MORE STORAGE IN THIS AREA? THE ONE PLACE WE CAN IS IN THE HOPKINS CREEK DITCH ITSELF BETWEEN PLAZA AND THE SHOPPING CENTER AND BEACHES AQUATIC CLUB.

BY OPENING THAT DITCH UP AND SHEET PILING ON ONE SIDE OF THE DITCH OR BOTH SIDES OF THE DITCH TO PROVIDE THAT EXTRA STORAGE THAT'S BEEN RECOMMENDED.

UM, SHEET PILES REALLY EXPENSIVE, ESPECIALLY WHEN YOU HAVE TO PUT IT IN THERE BECAUSE IT'S ALL CANTILEVERED, YOU CAN'T TIE IT BACK.

SO, IT'S BIG STEEL SHEETS WITH CONCRETE CAP ON IT, SIMILAR TO WHAT YOU SEE.

IF YOU WENT DOWN PENMAN ROAD BY FLETCHER AND LOOKED AT THE PROJECT, IT LOOKS SOMETHING SIMILAR TO THAT, AT LEAST ON ONE SIDE OF THE DITCH.

SO THE TRICK IS TO FIGURE OUT IF WE'RE GOING TO CONSTRUCT A POND, SAY IN THIS DOOR PROPERTY, HOW MUCH OF THAT CONSTRUCTION WOULD THAT OFFSET DOWNSTREAM THAT WE WOULD NOT HAVE TO DO.

AND I CAN TELL YOU, I'M ALMOST POSITIVE IT'S GREATER THAN A 1 TO 1.

HOW MUCH? I DON'T KNOW.

BUT WE'LL DO A LITTLE BIT MORE DETAILED ASSESSMENT OVER THE NEXT COUPLE OF WEEKS AND COME BACK WITH THAT ANSWER FOR YOU.

THAT INCLUDE THAT. I'M SORRY, DOES THAT INCLUDE THE FACT THAT WE'RE USING ARPA MONEY TO BUY DOOR PROPERTY, WHICH WE WOULD NOT BE USING TO TO TO WIDEN THE DITCH? WE DON'T HAVE ANY MONEY AVAILABLE TO US RIGHT NOW TO WIDEN THAT DITCH.

AS FAR AS THAT HOPKINS CREEK IS THAT PHASE, HAS THAT EVEN BEGUN? IT'S THE FIRST MAJOR PROJECT IS OUT TO BID RIGHT NOW.

IT'S OUT TO BID AND THAT'LL RELIEVE A LOT OF THE ISSUES THAT WE HAVE.

NOT ALL OF THEM, BUT IT WILL RELIEVE A GOOD PORTION OF THEM.

SO THE RELATIONSHIP OF DOOR DRIVE AND CONNECTION TO HOPKINS CREEK, YOU SAID YOU THOUGHT IT'D BE A ONE ON ONE THOUGHT THE COST WOULD BE AT LEAST 1 TO 1, IF NOT MORE.

SO HAVING DORA DRIVE, LET'S SAY WE YOU KNOW, WE GO WITH THE 45 DAYS, IT COMES BACK AS CONTAMINATED.

BUT THEN WHAT DO WE DO AS FAR AS WE'RE GOING TO EXPAND ON HOPKINS CREEK? YEAH, WE GO BACK TO WHAT WE WERE LOOKING AT WITH PROVIDING MORE STORAGE DOWNSTREAM.

SO, WHAT WE'RE LOOKING AT IS WE'RE TRYING TO FIGURE OUT WHAT'S THE MOST INEXPENSIVE WAY WE CAN GET THIS DONE AND MEET THE OBJECTIVES THAT ARE IN THE RECOMMENDATIONS THAT OUR STORMWATER MASTER PLAN.

AND WE TOOK INTO ACCOUNT ALL THE DIFFERENT DEMOGRAPHICS, THE DIFFERENT AREAS OF TOWN, NUMBERS OF PEOPLE SERVED WHAT IS HAPPENING, SO THAT WHEN WE ASK FOR PEOPLE TO APPLY FOR THESE GRANTS, WE ARE ABLE TO LOOK AT THAT AND FILL SOME HOLES WHERE WE FEEL WE NEED TO UPGRADE SOME SERVICES THERE. ONE THING I DO WANT TO BE I WANT TO MENTION IN THE 2022 PRIORITY SETTING THAT THE COMMISSION DID. LIVABILITY WAS FIRST AND FOREMOST AND STRONG WITHIN LIVABILITY WAS PROVIDING ARTS AND CULTURE AND RECREATION OPPORTUNITIES FOR OUR COMMUNITY.

LIVABILITY WAS NOT MENTIONED IN THE 2023 PRIORITY SETTING THAT THE COMMISSION DID, BUT I ASSUME IT'S STILL A PRIORITY FOR OUR COMMUNITY.

I RECOGNIZE THE GENTLEMAN THAT SPOKE ABOUT THE $75,000 THAT WE DISTRIBUTE, AND I'D LIKE TO

SO, THIS WHAT WE LEARNED IN THIS LAST YEAR, ASIDE FROM GOING THROUGH THE THE GRANT PROCESS ONLINE, THE APPLICANTS HAD TO ANSWER FIVE QUESTIONS THAT IF THEY IN ANY WAY ANSWERED NO TO ONE OF THOSE QUESTIONS, THEN THEY JUST WERE KICKED OUT OF THE SYSTEM AND THEY THEY WEREN'T ABLE TO GO ON.

IF THEN THEY HAD TO COME TO US, IF THEY MADE IT THROUGH THAT THEY HAD TO FILL OUT THIS ONLINE PROCESS TELLING US WHO THEY WERE GOING TO SERVE.

WAS THERE ANY COST TO THE COMMUNITY MEMBERS THAT PARTICIPATED? EVERY SINGLE ONE OF THEM SAID NO.

THERE WAS NO COST.

HOW MANY ATLANTIC BEACH RESIDENTS WERE SERVED? WHERE ARE THEY DOING THIS? HAD THEY TALKED TO THE PARKS AND RECREATION PEOPLE TO MAKE SURE THAT THIS WAS SOMETHING THAT WOULD, YOU KNOW, KIND OF JIVE WITH WHAT WE'RE ALREADY DOING? AND THEY HAD TO COME AND MAKE A PRESENTATION.

THEY DID ALL THAT.

WE DELIBERATED AND SCORED BASED ON THEIR WRITTEN APPLICATION, BASED ON LETTERS OF RECOMMENDATION, AND THEN THEIR PRESENTATION DISTRIBUTED THE MONEY.

AND THROUGHOUT THE YEAR THAT THEY HAD TO PERFORM THEIR PROGRAMING, WE ASKED FOR A PROGRESS REPORT, I THINK IT WAS IN JUNE.

AND THEN AT THE END OF THE BEFORE THEY COULD REAPPLY FOR THIS NEXT GRANT CYCLE, THEY HAD TO SUBMIT A FINAL REPORT WHERE THEY HAD TO VERIFY ALL THE MONEY THAT THEY SPENT. THEY HAD TO VERIFY THE NUMBERS OF COMMUNITY MEMBERS SERVED AND PROVIDE FEEDBACK FROM DIFFERENT COMMUNITY MEMBERS.

SO, WE RECOGNIZE THAT THAT WAS OUR FIRST YEAR OF KIND OF GETTING IT ALL TOGETHER.

AND WE LOOKED AT SOME AREAS THAT WE CAN IMPROVE.

AND ONE AREA SPECIFICALLY THAT WE THINK WE CAN IMPROVE WAS SPECIFIC VERBIAGE IN OUR GRANT AWARD LETTER, OUR CONTRACT, IF YOU WILL, WHEN WE GIVE THE MONEY TO THE RECIPIENT THAT SPECIFICALLY STATES WHEN THEY NEED TO, BASED ON THE PRESENTATION AND THE GRANT THAT THEY SUBMITTED WHEN THEY NEED TO HAVE THEIR PROJECT OR PROGRAM COMPLETED BY.

PREVIOUS. THE LETTER JUST SAID IT HAD TO BE COMPLETED IN THE FISCAL YEAR.

AND I HAVE ALSO BEEN THERE WITH MAYPORT MIDDLE AND THE GARDEN AND WATCHING THAT GO IN AS WELL.

AND THIS WILL GO OUT IN THEIR LETTER WITH THEIR GRANT, WHY IT WAS DECREASED BECAUSE NORMALLY WE WERE JUST GIVING THEM THE $5,000 BECAUSE THEY DO SUCH A GREAT JOB.

SO TELLING THEM THAT HAD ONE OF THEM.

NOW DIAL-A-RIDE DOESN'T APPLY.
