THE CITY IS SUGGESTING AN ORDINANCE TO ENFORCE A RIPARIAN BUFFER AT THE ICW ON PRIVATE LANDS.
THESE LANDS WERE PURCHASED WITH SURVEYS IDENTIFYING LAND BOUNDARIES AND CAME WITH TITLE INSURANCE.
INSURING THE USE OF LAND AS DESCRIBED AT THE TIME OF ACQUISITION.
IS IT LEGAL FOR A CITY TO IMPOSE RIPARIAN BUFFERS OF 25 TO 50FT, WHICH ARE POLICED BY THE CITY ON PRIVATE LAND? IT SEEMS THAT BY RENDERING A PORTION OF THE PROPERTY UNUSABLE, THIS IN EFFECT WOULD CONSTITUTE EMINENT DOMAIN FOR AMANDA AND OTHERS.

IS THAT EVEN LEGAL? I THOUGHT THERE WERE VERY SPECIFIC STEPS A CITY HAD TO TAKE TO IMPLEMENT EMINENT DOMAIN, SUCH AS PUBLIC HEARINGS, FULL CITY MAILINGS, INDIVIDUAL LAND APPRAISALS, AND MANDATED TIME FRAMES FOR THE PROCESS TO UNFOLD.
THIS PLAN INCLUDES NONE OF THAT.
